Shoeply knows how important privacy is to its customers. This Privacy Policy describes the personal information we may obtain online and how we may use and disclose that information. We also explain the choices available to you regarding our use of the information, the steps we take to safeguard the information and how you may contact us if you have any questions about our privacy practices. 

We value honesty and transparency in a way that it makes possible for us to build a strong and solid relationship with you, our customers, based on trust and mutual benefits. Thus, taking into account the General Data Protection Regulation (EU 2016/679), we’ve developed a set of safety measures that intend to protect your data and update our Privacy Policy.

This Privacy Policy aims to explain how the Data Treatment Policy at Shoeply is handled. From the moment you decide to purchase or sell an item on our website, you accept our privacy policy as it is imperative for the successful delivery of our products.

1. Information About Us

This website www.shoeply.eu and the Privacy Policy are managed by Overcube S.A., based in Rua Abílio Lopes das Neves, n.º 593, Guimarães, Portugal, share capital of €500.000,00, registered in the Commercial Registry Office, with the NIF 514510781. Shoeply’s email address is customerservice@shoeply.eu.

When navigating through our website you are accepting and consenting the described terms and practices in this Privacy Policy.

2. Definitions

For the purpose of this Privacy Policy, the following terms shall have the meaning assigned to them below:

2.1. “User” someone who uses Website and has not yet registered as a Member.

2.2. “Member(s)” is/are any legal or natural person who has concluded an agreement regarding the use of the Platform with Shoeply and Overcube, and have an Account.

2.3. “Account” shall mean any retailer or brand that uses the Platform and includes all information visible on the Profile belonging to such Account. 

2.4. “Retailer” are Members who registered as a buyer (i.e. chose an Account which enables them to make request orders on the Platform).

2.5. “Brand” are Members who work directly with Shoeply and Overcube, and offer/sell their products on the platform.

2.6. “Retailer Account” shall mean a retailer Member’s technical and legal access to the Platform and will allow the Retailer to apply to the showrooms available online, and consequently place order requests all within one website.

2.7. “Order Request” means that the retailer has chosen the products and has proceeded with the order so that it can be approved by the brand.

2.8. “Platform” shall mean the online platform as provided by Shoeply after a login under the domain www.shoeply.eu.

2.9. “Showroom Request” means that the retailer has requested access to a certain showroom.

2.10. “Profile” is the information connected to an Account.

2.11. “Website” shall mean www.shoeply.eu , including all content and sub-domains thereunder.

 

3. Background and Scope of Privacy Policy

3.1. Shoeply (“we” or “us”) and Overcube operates the Website and thereunder, provides access to a Members-only Platform addressed to brands and retailers.

3.2. Shoeply and Overcube protects the privacy of all Members and strictly complies with all applicable data protection provisions, including the European General Data Protection Regulation (“GDPR”).

3.3. The following privacy policy informs about the processing of data that occurs towards Members, as well as about any data processing that happens independent of your registration or log-in.

 

4. Processing of Data during Registration, account/Profile Completion and updates

4.1. When you register for the services on the Platform, complete your Account or change such information, Shoeply and Overcube stores the information you insert about you, and your company as follows:

a. Retailer Accounts: If you register, change or complete a Retailer Account, such data includes: contact information, such as your name, your email address, phone number, your company’s name and VAT number, address and country, the new password you choose and your billing information.

b. Brand: If you work for a brand we collect some data that includes your name,  information about your company or the company you act for, for example the company’s name, website, minimum order quantity, revenue per year, target group, product group and certification requirements.

4.2. When navigating through our website: If you register for a Retailer Account or you are a Brand, we may save information about how you responded to our advertisements before signing up the account. For details please see below under Section 10.3.

 

5. Brand and Retailer Visibility on the Website

5.1. Brand Visibility: As soon as a brand starts selling on Shoeply, a page is created for it. This page will contain relevant information about the brand, product photos, among others. This page will be visible to Users and Members.

5.2. Retailer Visibility: The information provided by the retailer (section 4.1, a) will only be communicated to the brands when the retailer makes a showroom request. When an account is created and you request access to a showroom, the data shared in the account creation is shared with the brands.

Shoeply does not show the full name of natural persons outside of the Platform.

 

6. Legal Basis for Data Processing of Registered Users

6.1. If you are a Member, the legal basis of data processing as described under Sections 3.

6.2. If you are an employee or other person acting on behalf of a Member (e.g. you work for a company who subscribed to the Platform as a Member), the legal basis of such processing is based on your consent towards your employer/principal according to Art. 6 para. 1, lit. a) GDPR or the legitimate interests of your employer/principal according to Art. 6 para. 1 f) GDPR. If in doubt, please refer to your employer/principal’s privacy policy.

 

7. Information Sharing

7.1. As a Member, we automatically include you in our newsletter mailing list. The purpose of sending such newsletters is to inform you about latest developments, platform & feature updates and to provide relevant information about the market and instructions on how to use the Platform. This will also be the way we will contact you about new orders:

a. For Brands we will send notifications of new order requests, order change requests accepted, order change requests not accepted.

b. For retailers we will send notifications of new order placed, order request confirmed and order change request.

7.2. We use a third-party provider “Klaviyo” to send such newsletters. Klaviyo is provided by Klaviyo, Inc. 60 South Street, Suite 910 Boston, Massachusetts 02111, USA. Klaviyo may receive your identification and contact data (provided when you apply for an account on our website. See the information required in section 3.2), as well as IT information (IP addresses, usage data, Cookies data, location and browser data).  Such information is stored and processed on Klaviyo’s servers in the US. Such data transmission is allowed under the EU commission’s decision about the adoption of the EU-US data protection framework “Privacy Shield” (https://www.privacyshield.gov/welcome). Klaviyo is certified under this EU-US Privacy Shield Framework. In connection with the performance of its services for us, Klaviyo’s newsletters employ the use of Cookies, unique identifiers, web beacons and similar tracking technologies. Such Tracking Technologies are only used in order to provide you a more personalized newsletter. 7.3. Shoeply can change the third party provider without prior notice to users of the website. All information regarding third party providers will be updated in the Privacy Policy.

7.4. As a Member, the legal basis of processing your data in order to send you newsletters are our legitimate interests according to Art. 6 para. 1, lit. f) GDPR. As a non-Member, the legal basis of processing your data in order to send you newsletters is your consent according to Art. 6 para. 1, lit. a) GDPR.

7.5. Shoeply will also share your data with the following:

  • providers of data aggregation and analytics software services that enable us to effectively monitor and optimise the delivery of our services;
  • providers of tracking tools that we use to monitor instances where you click on a link to Shoeply's website;
  • carrier/transport providers, that deliver the items bought through Shoeply to be delivered to you;
  • providers of software platforms that assist us in communicating or providing customer support services to you - for example, we manage and respond to any messages you send to us via our help centre using a third party communications management tool
  • providers of online cloud storage services and other essential IT support services.

 

8. How we use information we obtain

8.1. Shoeply may use the personal information we obtain to:

  • communicate with you;
  • provide customer support;
  • operate, evaluate and improve our business, including developing new products and services, managing our communications, analysing our Services and customer base, conducting market research, aggregating and anonymising data, performing data analytics, and undertaking accounting, auditing, training and other internal functions;
  • protect against, identify and prevent fraud and other criminal activity, claims and other liabilities; and
  • comply with and enforce applicable legal requirements, relevant industry standards and our policies, including this Privacy Policy and the applicable Terms of Use for a Service .
  • We may combine information we obtain about you for the purposes described above.  We also may use the information we obtain in other ways for which we provide specific notice at the time of collection or otherwise with your consent.

 

9. Processing of data in case of communication towards us

9.1. The Website contains information which makes it possible to contact us quickly and directly by the email customerservice@shoeply.eu. The personal data you transmitted is automatically stored in order to process your request. The data you communicated will not be transferred to third parties. It will only be stored as long as we need to deal with your request (e.g. to answer your question), but minimally as long as we are legally obliged to store such data.

9.2. The legal basis for such processing and storage can be found in Art. 6 para. 1, lit. c) GDPR.

 

10. Your Rights

10.1. To exercise your right of access, rectification, erasure, forgetting or blocking of your personal data you can send a written communication to the following email address: customerservice@shoeply.eu.

10.2. If you wish to stop receiving direct marketing communications, you may at any time exercise your right to object to the processing of your personal data by sending an email to customerservice@shoeply.eu.

 

11. Security

11.1. Shoeply and Overcube uses safety measures that fit the protection of your personal data against accidental or illegal destruction, accidental loss, change, dissemination or unauthorized access and against all other illegal treatment possibilities. Additionally, we demand all trustworthy external entities that handle your personal data, through a contract, that they do the same for us.

11.2 However, Shoeply and Overcube may not ensure that all safety manners adopted for the protection of this website and the dissemination of data and information through it are going to be able to prevent or exclude any undenied access or data loss. Being so, we advise you that you protect your computer with software that is able to protect you in the transmission and reception of data (such as an updated antivirus) and that your browser takes all the appropriate measures to ensure a safe transmission of data (such as a firewall and anti-spam filters). 

 

12. The purposes of the personal data treatment

12.1. Your data is collected and processed by Shoeply and Overcube only for purposes strictly linked to the use of this site, its associated services and the sale of products, management and improvement of the Loyalty Program, direct marketing and support management.

12.2. Shoeply and Overcube strives to maintain a relationship with its members and provide them with the relevant benefits, information and content related to our brand. Your data will only be processed for these specific, explicit and legitimate purposes, and will not be further processed in a manner inconsistent with it. The data collected and processed is appropriate, relevant and not excessive in relation to these purposes.

12.3.However, your personal data may also be used for other processing operations within the limits of such applications. In particular, your personal data may be processed for the following purposes:

a) when you make a order request on this site, we will collect the necessary information to the invoice and shipping;

b) when you request assistance from our Customer Support we collect your personal information (for example, first and last name, email address) solely for the purpose of providing you with Members Support services from the online www.shoeply.eu website that are relevant to this site and to offer you the assistance you requested;

c) when you apply for an account with us, we will collect your personal data in order to simplify the process of your future orders;

d) when you are navigating through our website, we collect Cookies. Depending on the Cookies management you have done on our website and on your interaction with us, we use some information collected through Cookies to ensure the righteous performance of the website, highlighting the proper visualisation of the content, remembering your checkout activity, your registration, fitting the resolution of your screen, improving our offers, among others. This information includes data such us registration, localisation, duration of your session, products you have selected, your equipment, your browser and your IP address;

e) when you are navigating on our website and then you visit other platforms that bear publicity formats (social media, Google and other partners of this network) you may be affected by advertisements of our brand. We will equally use the data to reach new and potential users that may have interest in being Members.

12.4. Your personal data can be shared with Shoeply and Overcube’s service providers for purposes of providing services and with legal, tax and regulatory authorities with the main purpose of assuring all legal matters.
